IMPLEMENTATION OF MMDA RESOLUTION NO. 12-01 SERIES OF 2012, “ESTABLISHING A MOTORCYCLE LANE ALONG EPIFANIO DELOS SANTOS AVENUE (EDSA)”

Quoted hereunder for the guidance of all concerned is MMDA Resolution No. 12-01, Series of 2012, “Establishing a Motorcycle Lane Along Epifanio delos Santos Avenue (EDSA),” to wit:

WHEREAS, the number of motorcycles traversing Epifanio delos Santos Avenue (EDSA) has steadily proliferated; for the Year 2011, 6,559 were observed to ply the Northbound lane and 5173 along the Southbound lane on a daily basis, representing a nineteen percent (19 %) increase from the Year 2010;

WHEREAS, motorcycles cause traffic congestion and endanger the safety of motorists and vehicle riders;

WHEREAS, from 2009 to 2010, there was a marked seventy-two percent (72%) increase in motorcycle-related accidents along EDSA that resulted in damage to property and physical injuries, both fatal and non-fatal;

WHEREAS, the number of motorcycle-related accidents only slightly decreased during Calendar Year 2011, and still represented a sixty percent (60 %) increase from Calendar Year 2009;

WHEREAS, there is an urgent need to adopt additional measures to address the alarming increase in motorcycle-related accidents;

WHEREAS, last year, the MMDA established motorcycles lanes along Commonwealth Avenue in Quezon City and Macapagal Avenue in the cities of Pasay and Paranaque;

WHEREAS, the establishment of the said lanes resulted in the orderly flow of traffic along the said major thoroughfares;

WHEREAS, in line with this Authority’s public safety and traffic management mandates under Republic Act No. 7924, there is also a need to reserve a special, non-exclusive motorcycle and scooter lane along Epifanio delos Santos Avenue as herein provided;

WHEREAS, Section 3 of Republic Act No. 7924 provides that the MMDA’s scope of services include services which have metro-wide impact and transcend local political boundaries, including transport and traffic management which include the formulation, coordination and monitoring of policies, standards, programs and projects to rationalize the existing transport operations, infrastructure requirements, the use of thoroughfares, and promotion of safe and convenient movement of persons and goods; and the institution of a system to regulate road users;

WHEREAS, Section 5 of Republic Act No. 7924 provides that the MMDA shall set the policies concerning traffic in Metro Manila, and shall coordinate and regulate the implementation of all programs and projects concerning traffic management, specifically pertaining to enforcement;

NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA 7924, that the Metro Manila Council hereby approves and adopts the following guidelines concerning the designation of a non-exclusive motorcycle lane along Epifanio delos Santos Avenue (EDSA) and imposing fines and penalties for violations thereof, as follows:

SECTION 1. Establishment of EDSA Motorcycle Lanes. A non-exclusive lane for motorcycles and scooters is hereby established along both sides of EDSA, Northbound and Southbound (the EDSA Motorcycle Lanes), as follows:

1.1. One (1) EDSA Motorcycle Lane shall be on each of the Northbound and Southbound lanes of EDSA.

1.2. The EDSA Motorcycle Lane shall be the fourth (4th) lane from the right sidewalk.

1.3. The EDSA Motorcycle Lanes shall run the length of EDSA from Monumento, Caloocan City to SM Mall of Asia in Pasay City, and vice versa.

1.4. To properly advise and inform the public of the location of the EDSA Motorcycle Lanes, the said lanes shall be identified with road markings and signages in accordance with international standards.

SECTION 2. The term “non-exclusive”, when used in this Resolution shall mean that private vehicles, with the exception of Public Utility Buses (PUBs) may also traverse the EDSA Motorcycle Lanes. However, unless otherwise provided in Section 3 hereof or when necessitated by emergencies, motorcycles and scooters may not use the other lanes of EDSA.

SECTION 3. Motorcycles and scooters may deviate from the EDSA Motorcycle Lane when making a turn or U-turn at authorized streets or U-turn slots; Provided, that the said vehicles shall gradually shift to the side of EDSA without swerving, and shall begin shifting lanes not less than two hundred meters (200 m.) from the relevant street or U-turn slot, making the appropriate signals and observing all other traffic rules and regulations.

SECTION 4. The penalty for violation of Sections 1, 2 and 3 above shall be Php 500.00.

SECTION 5. This Resolution shall take effect ten (10) days after publication in two newspapers of general circulation.

The foregoing MMDA Resolution shall be implemented beginning February 14, 2012.

SUBJECT: TEMPORARY SUSPENSION OF EXCAVATION ACTIVITIES ON ALL METRO MANILA ROAD RIGHT OF WAY

In view of the projected increase in the volume of vehicular and pedestrian traffic that will inevitably be brought about by the onset of the Yuletide Season, all excavation activities in all Metro Manila road right of way are hereby ordered temporarily suspended except Flagship Projects by the Government effective midnight of 15 December 2010 up to midnight of 02 January 2011, pursuant to the pertinent provisions of MMDA Ordinance No. 2, Series of 1991, “An Ordinance Governing Road Diggings/Excavations and Restoration in Metropolitan Manila”, which amended MMA Ordinance No.82-01 and with the promulgation of amendatory MMDA Regulation No. 98-009.

It is likewise advised that appropriate measures be undertaken to ensure that the affected roadways remain passable, clean, and serviceable to all vehicles and pedestrians during the period.

Any violation of the above mentioned order shall warrant imposition of fines and penalties as provided under Section 3 of MMDA Regulation No. 98-009.

This Circular takes effect upon approval.

TO: ALL OFFICIALS AND EMPLOYEES OF THE AUTHORITY

SUBJECT: MMDA as a 100% Smoke-Free Workplace

In accordance to the Civil Service Commission Memorandum No. 17 entitled, “ Smoking Prohibition based on 100% Smoke-Free Environment Policy”, and Republic Act 9211 otherwise known as the “Tobacco Regulation Act of 2003”, the Metropolitan Manila Development Authority is hereby enforcing policies towards attaining a 100% Smoke-Free model workplace in the Philippines.

  • All MMDA employees including traffic, field and office-based personnel, are directed to refrain from smoking within the premises of the office and field of assignments.
  • MMDA clients, guests and visitors are prohibited to smoke within the premises of the MMDA building. Employees are directed to inform clients, guests and visitors of this policy.
  • Smoking is prohibited in any MMDA vehicle.
  • Smoking paraphernalia (lighter, cigarettes, matches, ash trays, etc) are not allowed inside the MMDA buildings and offices. Security guards are directed to confiscate such items upon entry.
  • The Building Administrator and the Health, Public Safety and Environmental Protection Office (HPSEPO) shall ensure the strict compliance of this policy.
  • Employees violating this policy shall be dealt with accordingly:
    • First offense –reprimand
    • Second offense – suspension
    • Third Offense – dismissal

All employees are instructed to report violations on this memorandum to the Administrative Services for verification and recommendation of appropriate sanction.

HPSEPO is directed to prepare monthly report on the implementation of this policy.

MEMORANDUM CIRCULAR NO. 9

Additional guidelines on towing and impounding operations in Metropoitan Manila.

Pursuant to Section 12 of the “Guidelines on Towing and Impounding Operations in Metro Manila” which the Metro Manila Council adopted and approved August 29, 2002, through MMDA Resolution No. 02-33 (as amended by MMDA Resolution No. 02-52) the following additional guidelines are hereby issued.

Section 1. Coverage. All towing companies operating in Metropolitan Manila must apply for accreditation with the Metropolitan Manila Development Authority. Towing trucks or vehicles shall include privately or government owned towing vehicles, with or without public franchises, and those owned/accredited by motor vehicle repair shop, business establishments, transport groups, public utility companies, and private automobile clubs.

Accredited towing companies shall strictly adhere to existing laws and guidelines as mandated in MMDA ORDINANCE NO. 78-03 (as amended by Ordinance No. 03, Series of 1992 (No. 78-03-A), MMDA Regulation No. 96-003, series of 1996, MMDA Regulation No. 03-001. Series of 2003), the guidelines contained in MMDA Resolution No. 02-33 (as amended by MMDA Resolution No. 02-52), and those which are contained in this Memorandum Circular.

Section 2. Standard Color. MMDA Accredited Tow trucks shall have the standard color of “white with blue hood”.  The MMDA Accreditation Number, LTO plate number, and the phrase “For complaint, suggestions and inquiries, call MMDA Hotline 136” shall be permanently painted on both sides, front and back bumpers of the tow truck.  An authenticated copy of the valid Accreditation Certificates issued by the MMDA shall be kept in the towing vehicles and must be presented whenever required.

Section 3. Impounding Areas.  All applicants for accreditation of tow trucks or vehicles shall establish their MMDA approved impounding areas.  Otherwise, all impounded vehicles towed by MMDA accredited companies shall be impounded only at the ULTRA Impounding Area.

Impounding areas to be set up by MMDA accredited companies shall be approved by the MMDA prior to its use and the same must be properly insured and have an efficient system to ensure the safety of the towed vehicles.   MMDA shall have the authority to conduct inspection of the impounding areas.

Section 4. Towing fees and time of payment.  In accordance with the ORDINANCE NO. 78-03, as amended by Ordinance No. 03, Series of 1992 (No. 78-03-A), MMDA Regulation No. 96-003, series of 1996, MMDA Regulation No. 03-001. Series of 2003): the following fees shall be applied:

a) Any operator of public utility motor vehicle or owners of private motor vehicle or owners of private motor vehicle, whether natural or juridical, which shall stall on any public road, street or thoroughfare within Metropolitan Manila shall pay a fine of Two Hundred (P200.00) Pesos. In addition thereto, a standard towing fee shall be collected by both government and private entities subject to the following rates:

Cars, jeeps and pick-ups having gross capacity weight  of less than 4,000 kilos P800.00 for the first four kms. and P200.00 for every succeeding km. (pt. of reference: impounding area)

b) Any driver who shall illegally park his motor vehicle on any public road, street or thoroughfare in Metro Manila, shall pay a fine of FIVE HUNDRED (P500.00) PESOS. In addition thereto, a standard towing fee shall be collected by both government and private entities subject to the following rates:

Trucks having gross capacity weight of 4,000 kilos and above P1,400.00 for the first four kms. and P400.00 for every succeeding km. (pt. of reference: impounding area)
Cars, jeeps and pick-ups having gross capacity weight of less than 4,000 kilos P1,000.00 for the first four kms. and P400.00 for every succeeding km. (pt. of reference: impounding area)

c) Time of Payment. The fines and towing fees shall be paid within three (3) days from the date the vehicle was towed and impounded. Provided, however, that if the operator or owner of the vehicle fails to pay the fines and/or towing fees within the said period, an impounding fee of P80.00/day shall be imposed. Provided further, that if the vehicle is not redeemed by the operator or owner within a period of one (1) month from the date of apprehension, the same shall be sold at the public auction on the first Monday of the succeeding month. The proceeds of which shall be applied to the accumulated charges (fine, towing and impounding fees) and the excess, if any, shall be returned to the operator or owner.

Section 5. Transitory Provisions.   The MMDA Traffic and Transport Management Office (TTMO) shall supervise all towing operations within Metropolitan Manila and shall ensure proper implementation of the guidelines.  The TTMO shall immediately conduct the inventory and inspections of all impounding areas owned and/or accredited by the MMDA.

The MMDA TTMO shall likewise coordinate with all local government units of Metropolitan Manila to ensure proper implementation of towing regulations pursuant to MMDA Resolution No. 01-10, series of 2001, entitled “urging the Local Government Units of Metro Manila to Enact an Ordinance Prescribing Uniform Rules and Reglations on Towing and Impounding Operations”.

All currently accredited towing companies shall be given fifteen (15) days to comply with the foregoing requirements.

Section 6.  Repealing Clause. All issuances inconsistent with the foregoing are hereby amended or revoked accordingly.

Section 7. Effectivity. This Memorandum Circular shall take effect immediately.

AMENDMENT TO MEMORANDUM CIRCULAR NO. 04, SERIES OF 2010, ENTITLED “REVISED GUIDELINES ON THE ISSUANCE OF EXEMPTIONS FROM THE UNIFIED VEHICULAR VOLUME REDUCTION PROGRAM (UVVRP) UNDER MMDA REGULATION NO. 96-005, AMENDED”.

Whereas, there is a growing need to implement programs and projects to ease the worsening traffic condition in major thoroughfares in Metropolitan Manila;

Whereas, the MMDA Chairman is authorized to issue the necessary implementing guidelines under Section 3 of MMDA Regulation No. 96-005;

Whereas, there is a need to limit the coverage of exemptions being granted under the above-mentioned regulation;

Whereas, the Metropolitan Manila Council, in its meeting on October 15, 2010, adopted Resolution No. 10-16, Series of 2010, wherein it was decided that public utility buses, both provincial and city, should be included in the coverage of the Unified Vehicular Volume Reduction Program (UVVRP) under MMDA Regulation No. 96-005, as amended;

NOW THEREFORE, in view of the foregoing, the following amendments to Memorandum Circular No. 04, Series of 2010, entitled “Revised Guidelines on the Issuance of Exemptions from the Unified Vehicular Volume Reduction Program (UVVRP) under MMDA Regulation No. 96-005, as amended,” are hereby adopted:

Section 1. Public Utility Provincial and City Buses shall be covered under the Unified Vehicular Volume Reduction Program (UVVRP) from 7:00 A.M. to 7:00 P.M. Section 3 of Memorandum Circular No. 04, Series of 2010 is hereby amended by deleting sub-section c) thereof, and shall thereafter read as follows:

“Section 3. In addition to the foregoing, the following are also exempted from the UVVRP:

a)      Motorcycles pursuant to MMDA Memorandum Circular No. 96-005B (1998).

b)      DOT accredited tourism vehicles expressly marked as such.

c) Pursuant to MMDA Regulation No. 98-005-A, conduct passes shall be

granted to the following on a limited basis:

i.        Heavy vehicles delivering petroleum products,

ii.      Heavy vehicles undertaking international messengerial services,

iii.    Heavy vehicles utilized as garbage trucks,

iv.    Emergency heavy vehicles of power and water companies,

v.      Heavy vehicles being utilized by the government in the construction of flagship projects as identified by the MMDA and subject to the issuance of a valid certification and trip pass by the government authority concerned such as DPWH, DOTC, LGUs, PEA, et al.

vi.    Heavy vehicles carrying perishable goods in commercial quantity.

Section 2. Section 5 of Memorandum Circular No. 04, Series of 2010, is hereby amended to read as follows:

Section 5. Pursuant to this Memorandum Circular, except for vehicles mentioned under Section 2 (a), (b), (c), (d), (e), (f), (i), (j) and Section 3 (a), the MMDA shall issue exemption certificates and conduct passes in accordance with MMDA Regulation No. 96-005, as amended, MMDA Regulation 98-006-A, and MMDA Regulation 10-001.

All UVVRP exemptions and truck ban conduct passes granted under this section shall not include authority to use the Epifanio Delos Santos Avenue (EDSA).

Section 3. All previous memorandum circulars inconsistent with the foregoing are hereby modified, amended, or repealed accordingly.

Section 4. This Circular shall take effect on November 15, 2010.

SUBJECT: RELEASE OF IMPOUNDED VEHICLES DUE TO UNSETTLED VIOLATION

Effective August 10, 2010, all impounded vehicles due to multiple unsettled violations shall be released immediately after payment of all fines attributable to the operator/owner of the vehicle.

All previous orders or memorandum circulars inconsistent herewith are hereby revoked or modified accordingly.

SUBJECT: RELEASE PENDING ADJUDICATION

DATE: August 10, 2010

In order to decongest MMDA’s impounding areas and to expedite the release of all impounded vehicles which were recently apprehended in line with the MMDA Anti-Colorum campaign, all concerned units are hereby directed to immediately release all vehicles subject to the following conditions:

All vehicles subject for adjudication before the Traffic Adjudication Division (TAD) will be tagged with a red Sticker bearing the sign “Released Pending Adjudication” prior to the release.

Operator/Driver will sign an Affidavit of Undertaking to submit for adjudication their traffic violation before the MMDA-TAD within fifteen (15) days from release of impounded vehicle, attaching thereto a photocopy of competent evidence of identity.

The vehicle’s plate will be confiscated and shall only be released should the traffic citation be reconsidered, suspension/confiscation been lifted, or the corresponding suspension/confiscation has already been served.

Confiscation of plate/s and/or suspension of driver’s license of first time violators shall be lifted, after verification from the TVR-DATA through issuance of MRESS I and II, and payment of appropriate fine/s.

All previous orders or memorandum circulars inconsistent herewith are hereby revoked or modified accordingly.

AGM Corazon B. Cruz shall oversee the smooth implementation of this memorandum.

This memorandum circular shall take effect immediately.

FROM: Guidelines in the Selection of Traffic Enforcer of the Week / Month

Background:

The Traffic and Transport Management Office (TTMO) is one of the frontline offices of MMDA and is in charge of setting policies concerning traffic in Metro Manila. It is also responsible in coordinating and regulating the implementation of all programs and projects concerning traffic management specifically those that pertains to enforcement, engineering and education.

To date, the TTMO has a total manpower of 2,807,78% of which comprises the Traffic Enforcement Teams (2,210) deployed along the major thoroughfares of Metro Manila to man traffic, ensure a smooth traffic flow to promote efficient, safe and convenient movement of persons and goods in Metro Manila.

Considering that Traffic Enforcers have been noted for their dedication to their job even under adverse weather conditions and considering further that their character depicts the image of the Authority, it is but fitting to reward the Traffic Enforcers who have rendered public service in the performance of their duties.

Objectives:

The “Traffic Enforcer of the Week/Month” is being launched to reward outstanding Traffic Enforcers in order to encourage efficiency, productivity and further improve the integrity of public service particularly in the field of traffic management.

Guidelines:

Scope – The Program shall apply to all traffic officers and enforcers performing traffic direction and control functions, whether regular, casual or job order status;

Categories

1. Selection of the “Traffic Enforcer of the Week”

2. Selection of the “Traffic Enforcer of the Month”

Qualifications – nominated traffic officers / enforcers must meet the following criteria:

Must be in the service for not less than six (6) months at the time of the nomination;

Have been rated Very Satisfactory for the last performance rating period prior to the nomination;

Has no pending administrative or criminal case nor implicated in any reported illegal activities;

Has not incurred absences during the week/month.

Criteria for Evaluation:

Reliability, effectiveness and consistency in the performance of his/her assigned traffic direction and control functions;

Impact of the performance/achievement to his/her particular traffic district;

Courageous and selfless act in the performance of the traffic direction and control functions;

Performance and contributions to the improvement of the traffic management in his/her assigned area;

Consistent compliance to all MMDA Standard Operating Procedures for traffic management operations and to Civil Service and MMDA rules and regulations;

Procedure for Nomination:

Written nominations may come from the public, direct supervisors and/or any MMDA officer/supervisor who have seen or have knowledge of the worthy performance and/or exemplary behavior of the traffic officer/enforcer.

The recommending supervisor/official/private person must state and cite justifications on why the accomplishments are considered noteworthy or exceptional;

Nominations shall be submitted to the Director IV, Traffic and Transport Management Office (TTMO) for information and further comment;

The TTMO shall submit the recommendation to the Administrative Service duly endorsed by the TTMO Director;

Deadline for submission of weekly nominations shall be every Thursday of the week;

The “Traffic Enforcer of the Week” award shall be presented/awarded during the Flag Raising Ceremony immediately succeeding the week when he/she was selected;

The selected “Traffic Enforcer of the Week” shall automatically vie for the “Traffic Enforcer of the Month”;

Said nomination shall be subject for review/verification by the Administrative Service.

Awards and Incentives:

A Certificate of Recognition shall be given to the Awardee stating the category of the award. Monetary award shall be granted in accordance with the MMDA Program on Awards and Incentives for Services Excellence (PRAISE).

Effectivity: This Circular shall take effect upon approval.

MEMORANDUM CIRCULAR NO. 04

SERIES OF 2010

REVISED GUIDELINES ON THE ISSUANCE OF EXEMPTIONS FROM THE UNIFIED VEHICULAR VOLUME REDUCTION PROGRAM (UVVRP) UNDER MMDA REGULATION NO. 96-005, AS AMENDED.

Section 1. The following guidelines are hereby issued pursuant to the provision of Section 5 of MMDA Regulation No. 96-005 as amended.

Section 2. The following are exempted from the UVVRP in accordance with Regulation No. 96-005, as amended:

a) Cargo trucks and other heavy vehicles, whether empty or loaded, as defined in Section 2 of MMC Ordinance No. 78-04, as amended, shall continue to be covered by MMDA Ordinance No. 5, series of 1994 governing truck ban.

b) Ambulance, firetrucks, police patrol cars, military vehicles, with permanent marking indicating the vehicles as such. Ambulance and firetrucks which are privately owned and properly marked as such shall likewise be exempted.

c) Vehicles commandeered by government directed by a person in authority or his agent / or by a medical practitioner for military relief or emergency purposes.

d) Vehicles carrying person/s needing immediate medical attention.

e) Diplomatic vehicles with Diplomatic plates.

f) Government vehicles with government plates or appropriate LTO stickers with permanent markings expressly showing the name of government agency or office, including those vehicles of Members of Congress with officially issued LTO protocol plates and being utilized in the performance of their functions.

g) Duly enfranchised school buses, including school buses with provisional authority by the Land Transportation Franchising Regulatory Board (LTFRB), with appropriate LTO stickers and markings. Company buses/ shuttle service ferrying employees for free and with appropriate LTO stickers and markings are also exempted.

h) Official media vehicles with corresponding markings showing name/logo of the media firm and duly registered under the said firm as evidenced by valid registration papers. Privately owned vehicles being used by media personalities on official duties as attested by the concerned publisher / editor / station manager, are exempted provided that the written authority aforementioned is carried and ready for presentation upon request. A signboard, indicating the media establishment represented, shall likewise be conspicuously displayed on the vehicle.

i) MMDA accredited tow trucks provided that the accreditation papers must be carried and ready for presentation upon request.

j) Vehicles delivering perishable goods in commercial quantity.

k) Vehicles used by medical practitioners in an emergency.

l) Vehicles on a mission to carry relief goods to identified calamity or highly depressed areas.

Section 3. In addition to the foregoing, the following are also exempted from the UVVRP:

a) Motorcycles pursuant to MMDA Memorandum Circular No. 96-005B (1998).

b) DOT accredited tourism vehicles expressly marked as such.

c) Pending review of the Memorandum of Agreement dated July 15, 1996, members of the Integrated Metro Bus Operators, Provincial Bus Operators Association of the Philippines, and Southern Luzon Bus Operators Association are partly exempted in accordance with MMDA Memorandum dated July 22, 1996.

d) Pursuant to MMDA Regulation No. 98-006-A, conduct passes shall be granted to the following on a limited basis:

i. Heavy vehicles delivering petroleum products,

ii. Heavy vehicles undertaking international messaging services,

iii. Heavy vehicles utilized as garbage trucks,

iv. Emergency vehicles of power and water companies,

v. Heavy vehicles being utilized by the government in the construction of flagship projects as identified by the MMDA and subject to the issuance of a valid certification and trip pass by the government authority concerned such as the DPWH, DOTC, LGUs, PEA, at al.

vi. Heavy vehicles carrying perishable goods in commercial quantity.

Section 4. The Chairman of MMDA may grant additional temporary exemptions pursuant to existing regulations based on highly exceptional circumstances.

Section 5. Pursuant to this Memorandum Circular, except for vehicles mentioned under Section 2 (a), (b),(c),(d),(e),(f),(i),(l) and Section 3 (a), the MMDA shall issue exemption certificates and conduct passes in accordance with MMDA Regulation No. 96-005, as amended, MMDA Regulation 98-006-A, and MMDA Regulation 10-001.

Section 6. Exemption certificates which were previously issued but are no longer covered by exemptions enumerated under this circular are hereby revoked accordingly.

Section 7. All previous memorandum circulars inconsistent with foregoing are hereby modified, amended, or repealed accordingly.

Section 8. This Circular shall take effect on August 2, 2010.
